1. Agreement to Terms
These Terms and Conditions constitute a legally binding agreement between you and Nez & Co. LLC, doing business as Nova Source ("we," "us," or "our"), concerning your access to and use of thenezco.com and our services. By accessing the site or purchasing our services, you agree to be bound by these terms.
2. Customized Services and Fluidity
We provide highly customized digital services, including but not limited to custom website builds, Shopify and affiliate integrations, comprehensive "Revenue Engine" backend setups, ongoing digital marketing, and business consultations. Because every client's capacity and goals are different, our services are fluid and adapted to individual needs. We utilize industry-standard practices, but we do not guarantee specific financial results, return on investment (ROI), or exact timelines for business growth. You accept full responsibility for your business outcomes.
3. Digital Delivery
All services, consultations, digital products (such as the DIY Digital Marketing Launchpad), and receipts provided by Nez & Co. LLC are delivered digitally via email, CRM, or digital file transfer. You will not receive physical products or physical mail from us regarding your service delivery.
4. Strict but Fair Refund and Cancellation Policy
To protect the time, labor, and intellectual property invested in our custom services, and to remain fair to all parties, we enforce a strict refund policy:
• Consultations and Custom Builds:
Compensation for one-on-one consultations, website builds, and digital system setups is strictly non-refundable once the service has been rendered or the work has commenced. You cannot return intellectual property or executed labor.
• Digital Products: All sales of digital downloads, courses, and guides are final and non-refundable.
• Ongoing Services (Written Notice Required): For any recurring, month-to-month marketing services, you must submit cancellation requests in writing to jay@thenezco.com at least thirty (30) days prior to your next billing cycle. Failure to provide written notice will result in continued billing, and no retroactive refunds will be issued.
5. Privacy and Data Usage
We respect your privacy and are committed to protecting it. By using our services, you agree that we may collect and use your personal data strictly to deliver our services, communicate with you, and manage our relationship via third-party tools (like our CRM), as fully detailed in our Privacy Policy. We stand by our code: we will not sell, trade, or rent your personal information to third parties.
6. Intellectual Property
The site and our digital products, including course materials, website designs, text, and graphics, are owned by Nez & Co. LLC and are protected by copyright laws. You may not copy, reproduce, or distribute our course materials or custom systems without our express written permission.
7. Limitation of Liability
To the maximum extent permitted by Arizona law, in no event will Nez & Co. LLC, its owners, or affiliates be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, or punitive damages, including lost profit or lost revenue arising from your use of the site or our customized services.
